Today the Nevada Supreme Court issued its ruling on two consolidated cases challenging the state’s ESA program passed last year. The Court upheld the Constitutionality of the program on nearly every aspect, but struck down the funding source as being unconstitutional. This is encouraging news for us in Iowa – the Nevada ESA program withstood several Constitutional challenges and the only one that was upheld can be corrected by action of the legislature. We remain positive that someday we can achieve an ESA program in Iowa!
